Ozempic Overview

The prescription medication Ozempic is used to treat Type 2 diabetes. It contains semaglutide, which belongs to the class of drugs known as GLP-1 receptor agonists. These medications assist individuals with type 2 diabetes in managing their blood sugar levels. People also began taking Ozempic for weight loss. By the end of 2021, the FDA had received over 10,000 reports of adverse effects related to semaglutide, including numerous significant adverse events. Gallbladder and gastrointestinal conditions were linked to several of these side effects.

Who Is Eligible to File a Gallbladder Ozempic Lawsuit?

Ozempic and other semaglutide drugs, including Wegovy and Mounjaro, should carry stronger warnings, but they currently do not. Users may be able to seek redress and financial compensation through legal action. An Ozempic lawsuit may be an option for you if you or a loved one have:

  • Taken semaglutide – Ozempic, Wegovy, Mounjaro or another brand
  • Used at least three months prior to March 2022.
  • Developed complications involving the gallbladder, bile ducts, or digestive system

Eli Lilly Motion

Eli Lilly has filed a motion asking the court to rule that a reliable gastroparesis diagnosis must be based on objective, contemporaneous testing. They also seek to exclude expert testimony suggesting diagnoses can be valid without such testing. Lilly argues this is necessary to maintain scientific rigor, but critics say it imposes an unrealistic standard that doesn’t reflect real-world medical practices. Doctors often rely on symptoms, patient history, and clinical judgment, especially when tests are inconclusive. This motion seems aimed at limiting the number of claims by challenging the validity of diagnoses, which could weaken plaintiffs’ cases. We don’t expect this motion to succeed.

New NAION Study

A recent study in JAMA Ophthalmology explored the potential link between semaglutide and non-arteritic anterior ischemic optic neuropathy (NAION), a rare eye condition that can cause sudden vision loss. The study analyzed data from 37.1 million adults with type 2 diabetes, including over 810,000 new semaglutide users. It found a slight increase in the incidence of NAION among semaglutide users, with a rate of 14.5 cases per 100,000 person-years.

Though rare, the study raises questions about whether a warning should be issued so patients can make informed decisions about the drug’s risks. The authors suggest that healthcare providers consider this increased risk when prescribing Ozempic, Rybelsus, and Wegovy and discuss it with patients as part of a comprehensive benefit-risk assessment.

Prices Drop

Eli Lilly & Co. has announced a price reduction for its weight-loss and diabetes medication, Zepbound. The cost for single-dose vials will drop from $699 to $499 per month for self-paying patients. Two new dosage options (7.5 mg and 10 mg) will also be priced at $499 per month, and the 2.5 mg and 5 mg doses will now be $349 and $499 per month, respectively.

The price cut comes amid slower-than-expected sales growth, suggesting that while demand remains strong, some patients may be wary of the limitations and risks associated with the drug.

Ozempic MDL Sees Surge in January Filings

After a slow December, the GLP-1 Receptor MDL saw a rise in January with 110 new lawsuits, bringing the total to 1,443. While still lower than expected, our law firm continues to receive a steady stream of inquiries from individuals who’ve experienced severe gastrointestinal injuries from GLP-1 drugs like Ozempic.

New Lawsuit Filed

A Michigan woman has filed a lawsuit against Novo Nordisk, claiming Ozempic caused severe gastrointestinal injuries, including cyclical vomiting, constipation, and dehydration that required hospitalization. She alleges that Novo Nordisk downplayed these risks while aggressively marketing the drug as a weight-loss solution, failing to warn about long-term complications like gastroparesis and intestinal obstruction.

Motion to Dismiss Claims

Defendants in the Ozempic MDL, Novo Nordisk and Eli Lilly, have moved to dismiss several claims in the plaintiffs’ master complaint. While they’re not challenging the core failure-to-warn claims, they are trying to narrow the scope of litigation by targeting secondary claims. However, the evidence against them remains strong, particularly regarding the companies' failure to disclose severe gastrointestinal risks.

New Study Raises More Concerns

A new study published in JAMA found that patients using GLP-1 drugs like Ozempic and Mounjaro were at higher risk for thyroid cancer within the first year of use compared to those on other diabetes medications. While the study doesn’t prove causation, it adds to growing concerns about the potential risks of these drugs. The increasing evidence suggests there may be more serious side effects to investigate.

MDL Expected to Approach 10,000 Cases

During the latest status conference in the Ozempic MDL, lead counsel for the plaintiffs informed the judge that thousands, potentially tens of thousands, of cases could eventually be added to the MDL. This estimate was based on a poll of plaintiffs’ lawyers, revealing around 7,000 potential cases currently under investigation. The poll only included lawyers already involved in the litigation. Additionally, Judge Marston has scheduled an evidentiary hearing for May 20, 2025, to address early discovery and motions on issues including preemption, warning labels, and gastroparesis diagnostic testing standards.

Adding Saxenda, Not Blood Clot Injuries

The Judicial Panel on Multidistrict Litigation decided to include claims related to Novo Nordisk’s Saxenda in the GLP-1 MDL, but excluded blood clot-related injuries like deep vein thrombosis and pulmonary embolism, citing their lack of commonality with gastrointestinal injuries.

New Master Complaint

Plaintiffs in the Ozempic MDL filed a revised master complaint, refining their allegations against Novo Nordisk and focusing more on the drugs’ role in causing gastrointestinal injuries and other serious side effects. A master complaint consolidates common claims in an MDL, providing a roadmap for the litigation.
