Stephen D. Heninger and Amanda Williamson recently recovered $2,000,000 for their client who sustained severe injuries after being misdiagnosed with cancer as a result of a lab technician mixing up her biopsy slides with another individual’s slides. In the case of Smith vs. Trinity Medical Center, plaintiff was sent to an oncologist and was begun on chemotherapy and radiation treatment for her diagnosis of cancer.
She continued with her regimen of chemotherapy and radiation for over a year until she underwent a PET scan which showed no cancer. She sustained permanent injury to her colon from the radiation.
The trial began on Monday, June 20 and lasted four days. The jury only deliberated for 1 hour and 40 minutes before returning with a Plaintiff’s verdict of $2,000,000.00 in compensatory damages against Trinity Medical Center.
