On June 18th, in the third earplug trial against 3M, the plaintiff was awarded a total of $1.7M in damages for noneconomic damage, pain and suffering, and disability. The jury found 3M to be 62% at fault and the plaintiff to be 38% at fault. This is in addition to the $7.1M verdict from April that was in favor of three plaintiffs.

While this is a great sign of the values of these cases, each case is unique and has it own requirements of proof and damages. Also, it is important to note that this is a verdict, not a settlement, and will be significantly higher than any settlement for claims down the road. We still have to prove each case and damages. This verdict is only for this plaintiff and there has been no settlement or verdict for other particular cases.

What does this mean for my personal claim against 3M?
