The New York Times is publishing a series of in-depth articles investigating the corporate bullying tactic of forced arbitration. The first two articles in the series were published over the weekend: “Arbitration Everywhere, Stacking the Decks of Justice” and “In Arbitration, a Privatization of the Justice System.” The first article, was positioned prominently on the front page of Sunday’s paper.

The Times investigation was based on thousands of court records and interviews with hundreds of lawyers, corporate executives, judges, arbitrators, and plaintiffs in 35 states. The articles feature AAJ members and their clients, and explore the origins and progression of pre-dispute or “forced” arbitration clauses, their use and abuse, and the devastating impact they have on American workers, consumers, and patients.
