HGD Blog: The case for class action suits

At Heninger Garrison Davis, our attorneys often handle what is know as “class action” lawsuits. These cases involve multiple people who have been wronged in some way by a particular company. Before you know if your particular situation makes you a potential plaintiff in a class action suit, it is important to fully understand what we mean when we talk about class action cases. Here’s some need-to-know info courtesy of our knowledgeable class action attorneys at Heninger Garrison Davis:

  • What does “class action” mean?

A class action is a type of lawsuit in which one person or several people sue on behalf of a larger group of persons. This group is referred to as “the class.”

While the subject matter of class action lawsuits can be vastly different, two factors nearly every class action case have in common for all members of the class suing tend to be 1) the people affected are so numerous that it makes it impractical to bring them all before the court and 2) the issues in the dispute are shared among all members of the class. In essence, this means a large number of people who are somehow negatively impacted in the same ways by a particular company or entity are represented in class action cases.

Many of these cases started as the result of complaints by one person or a handful of people who were wronged in some way. Some of the most common class action suits involve fraud, deception, a defective product, or illegal conduct.

  • What are some types of class action suits?

People can be affected in a host of ways that can classify their situation as one requiring a class action. These are a few of the situations our attorneys have tackled:

  • Individuals who have been subjected to their personal, private information being shared or leaked without their consent or knowledge (examples include the Ashley Madison Data Breach and the recent Equifax Data Breach)
  • Investors who lost their savings due to fraudulent bank practices (Wells Fargo Phony Accounts Scandal)
  • Consumers who suffered health problems as the result of using products that did not adequately disclose health side effects (Roundup Herbicide causing Non-Hodgkin’s Lymphoma)
  • Individuals impacted by the willful nondisclosure of problematic or faulty components within a company’s product (Volkswagen Emissions Cheating and Fiat Chrysler Emissions Cheating)
  • Individuals charged by companies for services without their consent or knowledge (CenturyLink Overcharges)
  • Retirees who were promised a retirement benefit but the company ultimately took it away (Allstate Insurance Company Retiree Life Insurance)
  • What can I do if I believe I am eligible to participate in a class action suit?

False, misleading labels. Being charged too much for a particular service without being informed of the increase. Facing discrimination at work.  Being promised retirement benefits but not receiving them. These are all potential class action suits.
